Repossession Not Allowed

If you are thinking of repossessing a car owned by a member of our armed forces, think again. According to an article in ProRepo, military personnel on active duty are protected from repossession of their motor vehicles without permission of the court. So long as the individual bought the car before coming on active duty, and made at least one payment before coming on active duty, the lender must obtain court permission to repossess the vehicle. Further, if the repossesor knew that the owner of the vehicle was on active duty at the time that the car was unlawfully taken, the court may assess criminal penalties as well as civil penalties.
